Terms of Service
1. Agreement
These Terms of Service (the “Terms”) form a binding agreement between you and PartStop FZ-LLC (“PartStop”, “we”, “our”, “us”) governing your use of the PartStop mobile application and any related services (collectively, the “Service”). By creating an account or using the Service, you accept these Terms.
2. Eligibility & accounts
- You must be at least 18 years old and able to enter into a binding contract under UAE law.
- You agree to provide accurate, current information when creating an account and to keep it updated.
- You are responsible for safeguarding your account credentials and for any activity under your account.
- One person may not maintain multiple customer accounts. Vendor accounts must represent a single legal business.
3. Marketplace role
PartStop operates a marketplace that connects customers with independent third-party vendors of auto parts. PartStop is not the seller, manufacturer, or distributor of any product listed by vendors. The contract of sale for each part is between you and the vendor that fulfils your order. PartStop facilitates discovery, payment, and delivery on behalf of the vendor.
4. Orders, pricing & payments
- Prices are set by vendors and displayed in UAE Dirhams (AED) unless stated otherwise.
- An order is confirmed when the vendor accepts it within the app and payment has been successfully captured.
- All payments are processed by Stripe. By placing an order you authorise Stripe to charge the payment method you select.
- PartStop may charge a service fee, disclosed at checkout, on top of the vendor’s product price.
- If a vendor cannot fulfil an accepted order, you will receive a full refund of the product price to the original payment method.
5. Vendor obligations
Vendors using the Service represent and warrant that they:
- Hold all licences and authorisations required to sell their listed products in the UAE.
- List only parts they own and are legally permitted to sell.
- Describe products accurately (condition, OEM/aftermarket status, compatibility) and ship the exact item listed.
- Complete Stripe Connect onboarding (including KYC) before receiving payouts.
- Respond to customer messages and orders within the response window stated in their vendor agreement.
6. Delivery
Deliveries are performed by independent delivery partners or by vendors directly. Delivery time estimates are indicative. Risk of loss transfers to you on delivery to the address you provide. Where delivery fails because of an incorrect address you supplied, additional re-delivery charges may apply.
7. Returns & refunds
- You may request a return within 7 days of delivery if the part is materially different from what was ordered, faulty, or damaged in transit, in line with UAE Consumer Protection Law.
- Returns of correctly-supplied non-defective parts are at the vendor’s discretion and may carry a restocking fee.
- Electrical and consumable parts may be marked non-returnable; this will be disclosed before checkout.
- Approved refunds are issued via Stripe to the original payment method, typically within 5–10 business days.
8. Prohibited use
- Using the Service to sell counterfeit or stolen parts.
- Bypassing PartStop to settle the order outside the platform.
- Posting false, misleading, or defamatory content (including manipulated ratings).
- Attempting to access another user’s account, scraping data, or probing the platform for vulnerabilities without written permission.
- Using the Service for any unlawful purpose under UAE law.
9. User content & licence
You retain ownership of the content you upload (photos, videos, text). By uploading content you grant PartStop a non-exclusive, worldwide, royalty-free licence to host, display, and transmit that content solely for the purpose of operating and improving the Service. You represent that you have the right to share any content you upload and that it does not infringe third-party rights.
10. Intellectual property
The PartStop name, logo, app, code, design, and content created by PartStop are owned by PartStop FZ-LLC and protected by intellectual-property laws. You may not copy, modify, distribute, or reverse-engineer the Service except as permitted by law.
11. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. PartStop does not warrant that the Service will be uninterrupted, error-free, or free of harmful components.
Vendors are responsible for the accuracy of listings and the quality of parts. PartStop does not warrant the fit, condition, or performance of any part supplied by a vendor.
12. Limitation of liability
To the maximum extent permitted by UAE law, PartStop’s aggregate liability arising out of or relating to your use of the Service is limited to the greater of (a) the total amount you paid to PartStop in the 6 months immediately before the event giving rise to the claim, or (b) AED 1,000. PartStop is not liable for indirect, incidental, consequential, special, or punitive damages, including loss of profits or vehicle downtime, even if advised of the possibility of such damages.
13. Indemnity
You agree to indemnify and hold harmless PartStop, its officers, employees, and partners from any claim, demand, damage, or expense (including reasonable legal fees) arising out of (a) your use of the Service, (b) your breach of these Terms, or (c) your violation of any law or third-party right.
14. Suspension & termination
We may suspend or terminate your access to the Service if you breach these Terms, present a security or fraud risk, or as required by law. You may close your account at any time by emailing support@partstop.ae; closure does not refund completed orders.
15. Changes to the service
We may modify the Service, the features it offers, and these Terms from time to time. We will update the “Last updated” date above and, for material changes, give reasonable notice in the app or by email. Continued use of the Service after such changes constitutes acceptance.
16. Governing law & disputes
These Terms are governed by the laws of the United Arab Emirates. The courts of the Emirate of Dubai have exclusive jurisdiction to resolve any dispute arising out of or related to these Terms, except where consumer-protection law grants you a non-waivable right to bring proceedings in your local emirate.
